Pillsbury & Coleman managing partner Ryan Opgenorth recovered millions in unpaid cyber insurance benefits. The insured, a prominent technology company, suffered a shutdown of its website that resulted in a significant disruption of its business and millions in lost revenue. The shutdown was clearly a covered loss, but the insurance carrier refused to recognize the full value of the insured’s lost revenue. The carrier rejected the initial opinion of the forensic accountant selected by the insured and opted to retain its own forensic accountant, who quantified the loss at far less than what the insured’s accountant had calculated. There were disputes over the growth rate of the business, coverage for operating expenses, and the pre-conditions for coverage. Following two mediations, the parties were able to resolve their dispute in a confidential settlement.
